Intellectual Property & DMCA Policy

1. Our position

Filip Galinski designs its own graphics. Where our designs reference recognizable cultural material, they do so for the purposes of parody, satire and commentary. We claim no affiliation with, sponsorship by, or endorsement from any third party, and none of our products are issued or authorized by any government, agency, institution or professional body regardless of what the front of the shirt says.

We take intellectual property seriously in both directions. If we got something wrong, tell us and we will act.

2. If you believe we infringed your copyright

Send a written notice to our designated agent with all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act for them.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material you say is infringing, with enough detail for us to find it —

a product URL is ideal.

  1. Your name, mailing address, telephone number and email address.
  2. A statement that you have a good-faith belief that the use is not authorized by the copyright

owner, its agent, or the law.

  1. A statement that the information in the notice is accurate, and, under penalty of perjury,

that you are the owner or authorized to act on the owner's behalf.

We review every notice. Where a claim is valid, we remove or disable the material promptly and notify the person who supplied it.

Be aware: under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing can make you liable for damages, including costs and attorneys' fees.

3. Trademark complaints

For trademark rather than copyright concerns, email hello@poorjudgmentco.com with subject "Trademark Notice" and include: the mark, its registration number and jurisdiction, proof you own or represent it, the specific product URL, and why you believe the use creates confusion.

We will look at it seriously. We will also, where relevant, explain why we believe a use is protected parody or nominative fair use — but we will do that in a conversation, not by ignoring you.

4. Counter-notice

If material of yours was removed and you believe it was a mistake or misidentification, you may send a counter-notice containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake, your contact details, and your consent to the jurisdiction of the federal court for your district.

5. Repeat infringers

We terminate the accounts of, and stop working with, anyone who repeatedly infringes intellectual property rights.

6. Our own IP

Our designs, graphics, photographs, copy and the site itself are owned by Filip Galinski. You may not reproduce, print, resell, or create derivative works from them without written permission.

If you find someone selling our designs — this happens constantly in this category — email hello@poorjudgmentco.com with a link. We would genuinely appreciate it.

7. Design submissions

We do not accept unsolicited design submissions. If you send us one anyway, we are not obliged to review it, keep it confidential, or pay for it, and we may already be working on something similar. If we want to work with you we will approach you and we will pay you properly.
