Terms of service

These Terms govern your use of https://poorjudgmentco.com and any purchase you make from Filip Galinski ("Poor Judgment Co.", "we", "us"). By using the site or placing an order you agree to them. If you do not agree, do not use the site.

1. Who can order

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that you are.

We currently sell and ship only within the United States, including its territories where carriers permit. Orders with a shipping address outside the US will be cancelled and refunded.

2. Products, descriptions and images

We try hard to describe and photograph our products accurately, including garment measurements, fabric, fit and print method. Colors vary between screens and between production runs, and cotton is a natural fiber — garment measurements carry a tolerance of approximately ±0.5 inch.

Our products carry printed slogans and graphics that are intended as humor, parody and satire. They are not statements of fact about the wearer, about us, or about anybody else. No product on this site is issued, endorsed, certified or authorized by any government body, agency, medical authority, professional association or other institution, regardless of what it says on the front.

We reserve the right to limit quantities, refuse or cancel any order, discontinue any product, and correct pricing or description errors — including after an order has been placed. If we cancel an order you have paid for, we refund it in full.

3. Prices and payment

All prices are in US dollars and exclude sales tax and shipping, which are calculated and shown at checkout before you pay.

We collect and remit sales tax where we are required to. The applicable rate is determined by your shipping address.

Payment is taken when you place the order. If your payment is declined or reversed we may cancel the order.

We do not store your full payment card details. Payment is processed by our PCI-compliant payment providers.

4. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. The contract is formed when we dispatch the goods, which is also when we send the shipping confirmation.

We may refuse or cancel an order for reasons including: the item is out of stock, we identified a pricing or description error, we could not verify the payment or the address, or we suspect fraud or resale in breach of these Terms.

5. Shipping, delivery and risk

Shipping timeframes, costs and carriers are set out in our Shipping Policy, which forms part of these Terms.

Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery to the address you gave us. If a package is marked delivered and you cannot find it, contact us — we will help you chase the carrier, and we will make it right where the carrier is at fault.

If you give us an incorrect or incomplete address, we are not responsible for a package that goes to it. Contact us quickly and we will help if the parcel has not yet shipped.

6. Returns, exchanges and refunds

Our Refund Policy forms part of these Terms. In summary: 14 days from delivery, unworn, unwashed, tags attached.

Nothing in these Terms limits any right you have under applicable state or federal consumer protection law.

7. Acceptable use of this site

You agree not to:

use the site for any unlawful purpose, or to violate any law in your jurisdiction
submit false information or impersonate anybody
upload malicious code, scrape the site at scale, or interfere with its security features
use the site to harass, abuse or threaten anybody, including our staff
resell our products commercially without our written permission

We may terminate your access for breach of this section.

8. Reviews, photos and anything else you submit

If you submit a review, comment, photo, or tag us in content and give us permission to use it, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish and display that content in connection with our business, including in advertising, for as long as we operate. You confirm that you own it or have the right to grant this, and that it does not infringe anybody's rights.

We are not obliged to publish anything you send, and we may remove content at our discretion. We do not pay for submitted content unless we have separately agreed to.

If you want a photo of yourself taken down, email hello@poorjudgmentco.com and we will remove it from anything we control. We will do this promptly and we will not ask you why.

9. Intellectual property

All designs, graphics, text, photography and the site itself are owned by Filip Galinski or licensed to us, and are protected by copyright and trademark law. You may not reproduce, print, resell or create derivative works from our designs without written permission.

Third-party names, marks or references appearing in our designs, where any appear, are used for purposes of commentary, parody and satire. We claim no affiliation with or endorsement by any third party.

10. Disclaimers

The site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, except those that cannot be excluded by law. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Our products are novelty apparel. They are not protective equipment, not medical devices, and not certifications of anything. We make no representation that wearing any product is advisable in any particular setting. Where and whether you wear it is entirely your decision, and the social consequences of that decision are yours.

11. Limitation of liability

To the fullest extent permitted by law, Filip Galinski, its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site or any product.

Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order.

Some states do not allow the exclusion of certain warranties or the limitation of certain damages. Where that applies to you, these exclusions apply only to the extent permitted, and you may have additional rights.

12. Indemnification

You agree to indemnify and hold harmless Filip Galinski and its officers, employees and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.

13. Governing law and disputes

We are a Polish seller shipping to customers in the United States. These Terms are governed by the laws of Poland, and any dispute will be brought before the courts of Warsaw, Poland.

That does not take anything away from you. Nothing in these Terms removes the consumer protections you have under the mandatory law of the country and state where you live — including your rights against your card issuer or payment provider. Where those rules give you more than these Terms do, those rules win.

Before starting any formal proceeding, we ask that you email hello@poorjudgmentco.com and give us 30 days to resolve it. Most things are a misunderstanding about a parcel and we would rather just fix it.

There is no arbitration clause in these Terms and no class-action waiver. We are not asking you to sign away your right to take us to court. Ordinary courts apply.

14. Severability, waiver, entire agreement

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, constitute the entire agreement between us regarding the site.

15. Changes

We may update these Terms. The current version is always at this URL with its effective date. Continued use of the site after changes means you accept them. Changes do not apply retroactively to orders already placed.
